Official Rules of the Let Us Inspire You! 2019 Summer/Fall Photo Contest
The Let Us Inspire You! 2019 Summer/Fall Photo Contest (the “Contest”) is sponsored by the Photography Workshops Directory (“Sponsor”) and begins August 15, 2019 at 12:00:00 p.m. US Pacific Daylight Time (“PDT”) and ends November 30, 2019, 12:00:00 p.m. US Pacific Standard Time (“PST”). ALL ENTRIES MUST BE RECEIVED BY NOVEMBER 30, 2019 AT 12:00:00 P.M. PST. Information on how to enter and prizes form part of these official rules (“Official Rules”). By submitting an entry, each entrant agrees to the Official Rules and warrants that his or her entry complies with all requirements set out in the Official Rules. This is a skill-based contest and chance plays no part in the determination of winners.
Who Can Enter the Contest
Photographers of any level who are at least 18 years of age may enter the contest.
Employees of Photography Workshops Directory, and its participating workshop hosts, subsidiaries and affiliates, and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they live) or persons living in the same households of such employees, whether or not related are not eligible.
CONTEST IS VOID IN CRIMEA, CUBA, IRAN, NORTH KOREA, SUDAN, SYRIA AND WHERE PROHIBITED.
How to Enter ($20 per Entry Form, includes 5 images)
The Contest Entry Form has a base fee of $20 and allows you to submit up to five (5) photographic images. Additional images may be submitted to each Entry Form for an additional $5 per photographic image. All payments must be in U.S. currency. Subject matter is open.
To enter, visit https://photography-workshops.directory/photo-contest complete an entry form with the required information, including your name, address, telephone number, email address, and photo details; and submit along with your photograph(s) and fee.
There is no limit to the number of Entry Forms or photographic images an individual person may submit.
- Photographs must be in digital format. Only online entries will be eligible. No print or film submissions will be accepted for entry into this Contest. The photograph need not be taken with a digital camera; scans of negatives, transparencies, or photographic prints are acceptable. All digital files must be 10 megabytes or smaller, must be in JPEG or .jpg format, and must be at least 1,600 pixels wide (if a horizontal image) or 1,600 pixels tall (if a vertical image).
- Photographs that include sculptures, statues, paintings, and other works of art will be accepted as long as they do not constitute copyright infringement or fraud; provided entrants must be prepared to provide a release form as described below in “Release.” When photographing the work of others, it must be as an object in its environment and not a full-frame close-up of another person’s art.
- The photograph, in its entirety, must be a single work of original material taken by the Contest entrant. By entering the Contest, entrant represents, acknowledges, and warrants that the submitted photograph is an original work created solely by the entrant, that the photograph does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim, or interest in the photograph.
- The photograph must not, in the sole and unfettered discretion of the Sponsor, contain obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content.
- The caption must be complete and accurate, sufficient to convey the circumstances in which the photograph was taken. Disguising or misrepresenting the origin of your content is cause for disqualification.
- Watermarks are unacceptable. Unless Sponsor receives a non-watermarked version of the entry within ten (10) days following its request, the entry will be disqualified.
- ALL COPYRIGHTS REMAIN WITH THE PHOTOGRAPHER.
- Sponsor reserves the usage right to post images uploaded to the photography-workshop.directory website on our blog and social media outlets for the purpose of promoting the Contest, the winning entries, as well as the photography-workshop.directory website itself.
Judging consists of three (3) rounds of evaluation. Rounds Two and Three will be judged by three professional photographers (the “Judges”), each of whom specialize in providing photography workshops.
- Round One: the Sponsor’s photo editor will review each entry and select the top 10% of images to go on to Round Two.
- Round Two: the Judges will each select their top 10 favorite images. These favorite images will then go on to Round Three. There may be as many as 30 favorite images or as few as 10 favorite images that progress to Round Three, as Judges may each select the same image as one of their favorites.
- Round Three: each Judge will score each of the selected favorite images based on
- Technical Aspects
Winners will be determined based on top scores from Round Three. In the event of a tie, the tied images will be re-submitted to the Judges for a re-judging between the tied images alone. In the event that a tie remains after re-judging, the image with the highest score in the creativity criteria will be declared the winner. All decisions made by the judges are final. Photography Workshops Directory shall determine winner eligibility in its sole and absolute discretion. Winners will be selected on or about January 15, 2020 and notified by email or regular mail on or about February 15, 2020.
1st PLACE WINNER :: may select either a Workshop Credit* of up-to $2,500 (or) a $1,500 CASH PRIZE
2nd PLACE WINNER :: may select either a Workshop Credit* of up-to $1,250 (or) a $750 CASH PRIZE
3rd PLACE WINNER :: may select either a Workshop Credit* of up-to $750 (or) a $500 CASH PRIZE
Five (5) HONORABLE MENTION WINNERS :: may select either a Workshop Credit* of up-to $250 (or) a $100 CASH PRIZE
Winners will be contacted individually by email or regular mail to determine their prize selection. Once a prize selection is made (between a Cash Prize or a Workshop Credit), all initial selections are final and may not be reverted to the other choice. All Cash and Credit Prizes are in US Dollars. *Workshops Credits may be used towards a single Photography Workshop Directory listed (and available) workshop of their choice.
If a winner opts to receive a credit towards a single Photography Workshop Directory listed workshop of their choice, the winner may not receive cash in lieu of any difference between credit and the actual cost of the workshop. The credit may not be applied to multiple workshops. The Photography Workshops Directory is not responsible if the listed workshop of their choice is not available (i.e. is full to capacity and not accepting any further participants). It is the winners responsibility to ensure their listed workshop of choice is available before opting to select the Credit prize. Credits will be paid directly to the listed Workshop Host on behalf the winner. Credits are valid until December 31, 2020. If credit is unused by December 31, 2020 (along with previously having forfeited the cash prize in favor of the larger credit prize), the winner waives all claims to the credit.
Winner is responsible for all taxes and fees associated with prize receipt and/or use. Odds of winning a prize depend on the number of eligible entries received and skill of the entrant.
NONCOMPLIANCE OR RETURN OF PRIZE NOTIFICATION AS UNDELIVERABLE, WHETHER BY REGULAR MAIL OR BY E-MAIL, MAY RESULT IN DISQUALIFICATION AND SELECTION OF AN ALTERNATIVE POTENTIAL WINNER.

Upon the Sponsor’s request, each entrant must be prepared to provide a signed written personal release from all persons who appear in the photograph submitted (unless photographed in a public setting), authorizing us to reproduce, distribute, display and create derivative works of the image entry (along with a name credit) in connection with and promotion of the Contest and the Sponsor’s website, in any media now or hereafter.
In addition, upon the Sponsor’s request, each entrant must be prepared to provide a signed written license from the copyright owner of any sculpture, artwork or other copyrighted material that appears in the photograph entry, authorizing us to reproduce, distribute, display and create derivative works of the image entry (along with a name credit) in connection with and promotion of the Contest and the Sponsor’s website. Failure to provide such releases upon request may result in disqualification and selection of an alternate winner.
Limitation of Liability
By participating in the Contest, entrants agree to release and hold harmless the Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Contest, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the Released Parties) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Contest; © mechanical network, electronic, computer, human, printing or typographical errors; (d) application downloads, (e) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, the incorrect downloading of the application, the processing of entries application downloads or in any Contest-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Contest or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Contest, and in no event shall the entrant be entitled to receive attorney’s fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
In the case of entrants who are Australian or UK residents, the preceding clause does not operate in respect of any implied condition or warranty the exclusion of which from these Official Rules would contravene any Australian or UK statute or cause any part of these Official Rules to be void.
Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of California, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than California.
Entries are void if Sponsor determines the photograph to not be an original, or if the entries are incomplete, inaccessible or blocked, corrupted, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft.
By entering, entrants also agree (a) to be bound by these Official Rules; (b) that the decisions of the Judges are final and binding with respect to all matters relating to the Contest; and (c) if the entrant wins that Authorized Parties may use the winning photographs and each winner’s name, photograph, likeness, and/or voice in any publicity or advertising relating to the Contest or future promotions without compensation or approval (except where prohibited by law).
All federal, state/provincial/territorial, and local taxes, fees and surcharges and taxes (whether foreign or domestic, and including income, sales, and import taxes) on prizes are the sole responsibility of the prize winners. Prize winners will be issued an IRS Form W-9 with the Affidavit, and a subsequent IRS Form 1099. In the event that the selected winner(s) of any prize is/are ineligible, cannot be traced or does/do not respond within ten (10) days to a winner notification as required by the “Contest Prizes” rules above, or refuses the prize, the prize will be forfeited and Sponsor, in its sole discretion, may choose whether to award the prize to another entrant.
Sponsor reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant’s identity and address) and to disqualify any entrant who submits an entry that is not in accordance with these Official Rules or who tampers with the entry process. Failure by Sponsor to enforce any of its rights at any stage does not constitute a waiver of those rights.
Right to Cancel or Suspend Contest
If for any reason the Contest is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, an insufficient number of eligible entries meeting the minimum judging criteria are received or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest. If Sponsor elects to cancel or terminate the Contest, Sponsor will not retain any rights in the submitted photographs, and will return the fees submitted with each entry.
Entrants agree that personal data, especially name and address, may be processed, shared, and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules. The data may also be used by Sponsor in order to verify the entrant’s identity, postal address, and telephone number or to otherwise verify the entrant’s eligibility to participate in the Contest. Entrants have the right to access, review, rectify, or cancel any personal data held by Sponsor by writing to Sponsor at 269 ½ Oak Road, Santa Barbara, CA 93108. Personal data will be used by Sponsor and its affiliates exclusively for the purposes stated herein.
NOTICE TO INDIVIDUALS: REMOVAL FROM MAILING LIST: Any individual (or other duly authorized person) may elect to exclude the name and address of that individual from all lists used by Sponsor to mail skill contests or sweepstakes. To elect to have an individual’s name excluded from all such lists, submit a removal request in writing to: Photography Workshops Directory, Attention: Data Privacy, 269 ½ Oak Road, Santa Barbara, CA 93108. This notification system may be used to prohibit mailing of all skill contests or sweepstakes by Sponsor to such individual.
